Thank you for using Gully RPC! We built it so you can reach many blockchains with one API key instead of running your own nodes. We can’t know every customer personally, so these Terms of Service (“Terms”) set out the rules that keep the gateway fast and fair for everyone.
When we say “Gully Labs”, “we”, “our” or “us”, we mean Gully Labs LLC, based in Oregon, USA. When we say “Services”, we mean Gully RPC: the website gullyrpc.xyz, the customer portal at app.gullyrpc.xyz and the JSON-RPC gateway at rpc.gullyrpc.xyz, including the keyless Gully Chain endpoint. When we say “you” or “your”, we mean the person or organization that uses the Services or holds an account.
By creating an account, creating an API key, paying for a plan or sending requests to the gateway, you agree to the latest version of these Terms and to our Privacy Policy. If you use the Services for a company, you agree for that company and confirm you may do so. If you don’t agree, please don’t use the Services. These Terms contain a limitation of our liability and choose the law of the State of Oregon.
We may update these Terms. When we make a significant change we refresh the “Last updated” date above and tell account holders by email or in the portal before the change takes effect. If we don’t enforce a right or provision of these Terms at some point, that doesn’t mean we waive it.
Account terms
- You must be at least 18 and able to enter into a binding contract to use the Services.
- You may not use the Services if you, or anyone you act for, are the target of sanctions (including the lists kept by the US Treasury’s OFAC, the UN, the EU and the UK), or are located in a country or region under comprehensive US sanctions. You must not use a VPN or any other means to get around a restriction based on where you are.
- You sign in with an email address and password, or with Gully ID (the Gully Labs sign-in, which has its own terms). You are responsible for keeping your password, your Gully ID and your API keys secure, and for everything done with them. We can’t and won’t be liable for loss or damage caused by your failure to keep them secure. Tell us at [email protected] at once if you think someone else is using your account or a key.
- An API key is shown once, when you create or rotate it. Keep it private: send it from your server, not from code you publish. Anything done with your key counts as done by you. If a key leaks, rotate or revoke it in the portal.
- You must be a human. Accounts registered by bots or other automated methods are not allowed, and you may not create several accounts to get more free capacity.
- You may not use the Services for anything listed under Acceptable Use, and you may not let anyone using your keys do so either.
Acceptable use
The gateway is shared by many customers, so these restrictions matter. When you use the Services, you agree that you will not, and will not help anyone else to:
- Abuse the gateway. Send traffic meant to overload, degrade or disrupt the Services, the nodes behind them or other customers, including denial-of-service attacks, floods of invalid requests, and load or stress tests run without our written permission.
- Get around limits. Rotate keys, accounts, IP addresses or the keyless endpoint to exceed your plan’s rate limits or method rules, or otherwise evade quotas, payments or access controls.
- Use keys or data that aren’t yours. Collect, scrape, share or use other people’s API keys, sessions or account data, or try to access accounts, systems or networks you’re not allowed to.
- Break our security. Probe, scan or test the security of the Services, or circumvent, disable or interfere with security features. Found a vulnerability? Please tell us privately at [email protected]; responsible disclosure is welcome.
- Break the law. Use the Services for anything illegal, including fraud, scams, phishing, market manipulation, money laundering, terrorist financing, sanctions evasion, or spreading malware, or to help anyone who is the target of sanctions.
- Mislead or harm people. Trick, defraud or mislead us or others, impersonate anyone (including Gully Labs or its team), or harass, intimidate or threaten others or our team.
- Resell without permission. Resell, sublicense or offer the Services as your own RPC product, or share one key among unrelated customers, without our written permission. Building your own app on top of the gateway is fine.
- Misuse our brand. Use our names, logos or badges in a way that suggests we endorse you when we don’t.
We may throttle, suspend or revoke keys or accounts that break these rules, and we’ll try to reach you first unless the traffic is harming the Services or other customers. To report abuse, write to [email protected] with the endpoint, the time and what you saw.
Rate limits, plans and networks
Limits are enforced at the gateway, per API key, by your account’s plan. Today they are:
| Plan | Requests per second, per key | API keys | trace_* methods |
|---|---|---|---|
| Free | 25 | up to 2 | not available |
| Developer | 100 | up to 20 | not available |
| Business | 400 as sold (the gateway’s cap for this tier is currently 500) | up to 100 | available where an upstream supports them |
| Enterprise | 2,000 | by contract | available where an upstream supports them |
- On top of the per-key limit, the gateway applies a per-IP safety limit of 3,000 requests per second.
- The keyless Gully Chain endpoint (
https://rpc.gullyrpc.xyz/gullychain/evm/485590) needs no key. It serves only Gully Chain, is limited to 25 requests per second per IP address and blocks trace_* methods. It is a free public service for testing and light use, not a production plan. - Some methods that could sign transactions on a node or expose node internals are always blocked.
- Networks. The gateway serves the networks listed on the status page and in status.json. Today that is Gully Chain Testnet (chain ID 485590, alias gully-testnet), Ethereum, Base, BNB Chain, Arbitrum One and Robinhood, all marked beta. Networks marked “coming soon” are not served yet. Beta networks may change, break or be removed.
- We may change limits, methods and networks. We try to give notice in the docs before we remove something on purpose, and a change never cuts the limits of a period you have already paid for.
Upstream providers
Gully RPC is a gateway: to answer your request it forwards it to a blockchain node for that network. Some nodes are ours (today, the Gully Chain Testnet node). For other networks your requests pass through third-party upstream providers. The gateway’s current upstream list uses dRPC (paid), with public RPC endpoints from PublicNode, dRPC, Cloudflare (cloudflare-eth.com) and Base (mainnet.base.org) as fallbacks when no primary upstream is healthy.
The list changes as we add our own nodes and providers, and we keep the privacy policy up to date with it. We don’t control upstream providers and are not responsible for their availability or answers.
Payment, refunds and plan changes
- The Free plan is really free. We don’t ask for a card, Free stops at its limits and is never billed.
- Paid plans are paid through Gully Pay, the Gully Labs payment gateway, at its hosted checkout, in the payment methods it offers. Prices are in US dollars and shown on the pricing page and at checkout; the checkout price is the price you pay. The Gully Pay terms apply to the checkout itself.
- Each payment buys one prepaid 30-day period. Nothing renews by itself and we never charge you without you starting a checkout. We remind you 7 days before a period ends. Paying for the same plan again before it ends adds 30 days to the current end date.
- Upgrading to a higher plan starts its 30 days on the day you pay; the days left on the lower plan are not carried over or credited. Moving to a lower plan is possible once the current period has ended.
- When a period ends without a new payment, your keys keep their tier for a 3-day grace period and then move to the Free tier. Your account and keys stay.
- Prices exclude taxes. You are responsible for any taxes, levies or duties on what you buy, except where we are required to collect them.
- Refunds. Refunds are not automatic. If you were charged in error, paid twice, or a paid period didn’t work as described, write to [email protected] with your account email and the payment, and we’ll look at it fairly, case by case. Where we grant a refund, it is paid back through Gully Pay and the paid period may end early. A payment made on a blockchain can’t be reversed by the network itself.
Cancellation and termination
- You can stop using the Services at any time. Because nothing renews by itself, there is nothing to cancel: a paid period simply runs out.
- To have your account deleted, write to [email protected] from the account’s email address. We then delete your account, keys and usage records from our active database; database backups roll off within 14 days. Records we must keep by law (such as payment records) are kept for as long as the law requires. Revoked keys stop working at the gateway within about 30 seconds.
- We may suspend or end your access, or block an API key, if you break these Terms, if your use puts the Services or others at risk, or if the law or a sanctions rule requires it. Where practical we tell you first. We may also refuse service to anyone, for any lawful reason.
- Verbal, written or other abuse (including threats) of anyone on the Gully Labs team means immediate termination.
- The sections on payment, liability, indemnity and law survive the end of these Terms.
Changes to the Services and prices
We may change, add or retire any part of the Services, temporarily or permanently, including networks, methods, endpoints and features. Sometimes a node or provider goes away, or we find a better way to do something. When we change prices, the change never affects a period you have already paid for; for a price increase we give notice on the site or by email before it applies to your next period.
Uptime, security and privacy
- Your use of the Services is at your own risk. We provide them on an “as is” and “as available” basis. There is no service-level agreement unless one is written into a signed Enterprise contract. We do take uptime seriously; see the status page.
- If your usage significantly exceeds what your plan allows or harms other customers, we may throttle or temporarily disable your keys. We’ll reach out first, except when the traffic is hurting the Services.
- We protect your data with encryption in transit (HTTPS), hashed passwords and key hashes, private networks between our services, and daily database backups. Report a security issue to [email protected].
- We process personal data only as our Privacy Policy describes. People at Gully Labs look at account data only to help you when you ask (with your consent), to fix an error that stopped an automated process, to keep the Services and our customers safe (including abuse investigations), or when the law requires it.
Gully Chain Testnet and blockchain data
- Gully Chain Testnet is for testing. Testnet tokens and balances have no monetary value, can be reset, paused or removed at any time, and must not be sold or promised as having value.
- Answers from the gateway come from blockchain nodes and providers. They can be late, incomplete or wrong, and chains can fork, reorganize or stall. Check anything important before you rely on it.
- Transactions you send through the gateway are your own. They are public and permanent on their chain; we can’t change, cancel or delete them, and we never hold your funds.
- Nothing the Services return or show is investment, financial, legal or tax advice.
Content and intellectual property
- What you send through the Services stays yours. You give us a limited license to process it only to run the Services for you, as our Privacy Policy describes.
- Gully Labs or its licensors own the Services, including the portal, the sites, the Gully RPC name, logos and badges. You get no ownership rights by using them. Ask us before you use our logos for promotion; the badges on the docs page may be used as the docs describe.
- Parts of the Services are built on open-source software, which stays under its own licence.
Features and bugs
We design the Services with care, but no service pleases everybody, and we don’t guarantee they will meet your specific requirements. We test features before shipping them, yet all software has bugs. We track the bugs reported to us and work through the important ones first, especially anything to do with security or privacy. Not every bug will be fixed, and we don’t promise error-free Services.
Liability
We mention liability throughout these Terms; here it is in one place.
To the maximum extent the law allows, Gully Labs is not liable to you or any third party for any indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, revenue, goodwill, data or trading opportunities, even if told they were possible, resulting from: (i) using or being unable to use the Services; (ii) the cost of substitute services; (iii) unauthorized access to or changes to your requests, keys or data; (iv) answers from nodes, upstream providers or chains, or transactions you send; or (v) anything else relating to these Terms or the Services, whether in contract, tort (including negligence) or any other theory.
Our total liability for all claims relating to the Services or these Terms is limited to the fees you paid us for the Services in the prior 12 months. This never limits money we already owe you. Disclaimers: to the maximum extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.
Nothing in these Terms limits liability that the law does not allow to be limited, such as for fraud, or rights you have as a consumer that can’t be waived.
You will defend and indemnify Gully Labs against claims by others, and the resulting losses, costs and reasonable legal fees, that arise from your breach of these Terms, your misuse of the Services or your violation of law or of someone else’s rights.
Governing law and disputes
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Services will be brought only in the state or federal courts located in Oregon, and you and we consent to their jurisdiction. If you are a consumer, this does not take away mandatory protections of the law where you live.
General and contact
- Whole agreement. These Terms, the Privacy Policy and any Enterprise contract you sign with us are the whole agreement between us about the Services. If a written Enterprise contract conflicts with these Terms, the contract wins.
- Severability. If a part of these Terms is found invalid, the rest stays in force.
- Transfer. You may not transfer these Terms without our consent. We may transfer them as part of a merger, sale or reorganization of the business they relate to.
- Contact. Questions about these Terms, notices and requests: [email protected]. Gully Labs LLC, Oregon, USA.
